Liability Waiver for Tenn Little Birds Classes

COVID-19 ASSUMPTION OF RISKS AND WAIVER OF LIABILITY

As consideration for Tenn Little Birds permitting me to take Music Together® classes, I agree to the following:

ASSUMPTION OF RISKS:  I understand that naturally occurring disease processes (including, but not limited to, the novel coronavirus or COVID-19) may exist in the community, including at Tenn Little Birds, and present an inherent risk that cannot be eliminated.  I acknowledge that, although Tenn Little Birds is taking reasonable measures to avoid contact, transmittal, and exposure of disease processes like COVID-19 between people in our classes (including Music Together® Teachers and third-parties), it is ultimately my responsibility to ensure that my child and I take appropriate actions to safeguard ourselves, including all adults, and children three or older, wearing masks when arriving to, departing from, or leaving the family "spot" at any time during class. All family members must stay within their personal area and ensure that personal instruments/props are not shared between families. I understand and agree that as a registered family with Tenn Little Birds, I am accepting and voluntarily assuming the risk that my child or I may be exposed and become ill as a result of COVID-19 and other diseases. 

WAIVER OF LIABILITY: I, on behalf of myself and my children, hereby voluntarily release, forever discharge, and covenant not to sue Tenn Little Birds LLS and its owner, contractors, members, employees, and volunteers for any claims that may arise out of or relate in any way to my or my child's exposure to any communicable disease, including by not limited to the novel coronavirus or COVID-19 or any other accident that may cause harm. In addition, I also assume the inherent risk of being outdoors with my children including but not limited to ticks, bees/yellowjackets, insects, poison ivy, or other outdoor hazards. The claims hereby released include, but are not limited to, claims of negligence against any of the Released Parties. 

I HAVE CAREFULLY READ THIS WAIVER AND FULLY UNDERSTAND ITS CONTENTS.  BY ENROLLING IN CLASSES AT TENN LITTLE BIRDS, LLC, I UNDERSTAND I HAVE GIVEN UP CERTAIN LEGAL RIGHTS AND THAT THIS IS A BINDING LEGAL DOCUMENT.


The following Terms and Conditions apply to all programs as described below, upon competing an online registration or registering manually through the office.

Liability:  I release, indemnify and agree to hold harmless Tenn Little Birds, Allison Link, Music Together® LLC, and their respective directors, officers, employees, sponsors, teachers, and staff from any claim, suit, demand, or action arising in connection with mine or my child’s participation in programs operated at Tenn Little Birds. 

Media Release:  By signing up for a class at Tenn Little Birds, I understand and accept that on occasion, a photo or video may be taken of myself or my family to be used by Tenn Little Birds for the purpose of marketing the program.  If this is no acceptable for your family, please contact director Allison Link via email at [email protected].

Class Availability:  All classes are subject to minimum and maximum enrollment requirements.  Classes may be combined or split into two classes.  Class times may also be altered to suit enrollment.

Weather/Class Cancellation:  In the event of severe weather or teacher absence, you will be emailed/text the morning of class at the latest.  If TLB must cancel classes due to extreme weather or events beyond our control such as power outages, the missed classes will be added on where possible.  No refunds due to these reasons will be given.

Refunds/Credits:  Any family wishing to withdraw from classes may do so with a $30.00 cancellation fee BEFORE classes begin.  A credit will be applied to their account for a future semester for those who cancel after the first day of classes.  If materials have been received, there will be a $42.00 reduction of credit.  Refunds are provided only if the class you have paid for is canceled and you cannot attend an alternate class.  In all other cases, you may be credited toward a future semester at the discretion of the Director if there has been a medical or family emergency that has prevented your attendance in class.

Illness:  Please DO NOT bring children to class who may have a contagious illness, runny nose, cough, sneezing, etc.  The health of our classroom is essential, and we take measures to ensure cleanliness and limit exposure to germs.  If you or your child is not feeling well, please stay home!  We will happily help you schedule a make-up class for a later date. 

Injuries:  Parents, legal guardians of minor students and adult students waive the right to any legal action for any injury sustained at TLB venues resulting from normal class activity or any other activity conducted by families before, during, or after class time.

Make-Ups/Absences: Make-up opportunities are based on availability.  You MUST schedule in advance using the Makeup Scheduler to avoid overcrowded classes. No refunds are given for missed classes.

Teachers:  Teacher assignments are subject to change and do not warrant a class change or cancellation.

Class List Policy:  By enrolling in a Music Together class at Tenn Little Birds, a licensed Music Together center, you agree that any information you provide will be shared with Music Together Worldwide (MTW).  For information about how MTW uses and stores your personal information, we encourage you to review the MTW Privacy Policy.

Policy and Procedure Changes:  These Policies and Procedures are subject to change at any time.  All registered parties agree to the terms herein, as well as changes to these policies when posted to the website by signing and/or registering.
